Terms of Service

Welcome to Mawaheb (مواهب), a freelance marketplace platform operated at mawaheb.app("Mawaheb," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our platform, including all features, services, and content available through the Mawaheb website and progressive web application.

Please read these Terms carefully before using the platform. By registering an account or using any part of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account on Mawaheb, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are registering on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

Your continued use of the platform after any modifications to these Terms constitutes acceptance of the updated Terms. We will notify you of material changes via email or in-app notification.

If you do not agree to these Terms, you must not register for an account or use the platform.

2. Account Registration

Mawaheb uses a single-account model. When you register, you create one account that allows you to act as either a client (posting jobs and hiring freelancers) or a freelancer (submitting proposals and performing work). Your role is determined by context — by each action you take — not by a fixed account type.

To register, you must provide accurate and complete information, including your full name, email address, and phone number. Depending on platform settings, you may be required to verify your email address and phone number via one-time passwords (OTP) before gaining full access.

You are solely responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at info@mawaheb.app if you suspect unauthorized access to your account.

For security purposes, your account will be temporarily locked after 10 consecutive failed login attempts.

3. Platform Services

Mawaheb is an online marketplace that connects freelancers with clients in Palestine. We provide the technology infrastructure to facilitate job posting, proposals, contracts, escrow payments, messaging, dispute resolution, and reviews.

Mawaheb is not an employer, staffing agency, or contracting firm. We do not employ freelancers, nor do we supervise, direct, or control the work performed. Contracts formed through the platform are between the client and the freelancer directly. Mawaheb is not a party to these contracts.

We do not guarantee the quality, safety, legality, or timeliness of work performed by freelancers, nor the ability of clients to pay. Users engage with each other at their own discretion and risk.

4. User Conduct

By using Mawaheb, you agree not to:

  • Create fake profiles or misrepresent your identity, qualifications, or portfolio.
  • Engage in fraudulent activity, including submitting work you did not perform or claiming payment for undelivered services.
  • Harass, threaten, or abuse other users through messages, reviews, or any other platform feature.
  • Upload malicious software, viruses, or any content intended to disrupt the platform.
  • Share personal contact information (phone numbers, email addresses, social media handles) in job posts, proposals, or messages for the purpose of circumventing the platform and avoiding service fees.
  • Attempt to complete transactions outside of the Mawaheb escrow system for work initiated on the platform.
  • Post jobs or content that is illegal, discriminatory, or violates the rights of others.
  • Use automated tools, bots, or scrapers to access the platform without our written permission.

Uploaded files are restricted to the following formats: PDF, JPG, PNG, ZIP, DOC, and DOCX, with a maximum file size of 20 MB per file.

5. Job Posting and Proposals

Clients may post job listings that describe the work to be performed, budget, timeline, and any requirements. All job descriptions must be accurate, complete, and comply with applicable laws. Clients may not post jobs that require illegal activity or violate third-party rights.

Freelancers may submit proposals to posted jobs. A proposal includes a proposed price, estimated timeline, and cover letter. Submitting a proposal constitutes a binding offer to perform the described work at the stated terms.

When a client accepts a freelancer's proposal, a contract is created on the platform. The terms of the proposal — including the agreed amount and scope — become the binding terms of the contract. Neither party may unilaterally modify these terms after acceptance without the other party's consent.

6. Contracts and Payments

6.1 Contract Types

Mawaheb supports three types of contracts:

  • Fixed Price: The client pays the full contract amount upfront into escrow. The freelancer delivers the work, and the client approves or requests revisions. If the client does not respond within 7 days of delivery, funds are automatically released to the freelancer.
  • Hourly: The freelancer logs hours weekly (Monday through Sunday). An invoice is automatically generated every Monday for the prior week. The client is auto-charged and has 5 business days to dispute logged hours. If no dispute is raised, funds are released the following Wednesday.
  • Milestone: The contract is divided into phases defined at the time of hiring. Each milestone functions as an independent mini-contract following the fixed-price flow. The client must fund each milestone before the freelancer begins work on that phase.

6.2 Commission

Mawaheb charges a service commission on each contract. The commission is charged to the client and added on top of the freelancer's agreed amount. The freelancer always receives their full proposed amount — the commission is never deducted from the freelancer's earnings.

Commission rates vary by job category and are set by the platform administration. The commission rate applicable to a contract is locked at the time of contract creation and will not change for that contract, even if platform-wide rates are subsequently adjusted.

6.3 Escrow

All payments on Mawaheb are processed through our escrow system. When a contract is created, the client pays the total amount (freelancer's fee plus commission) into escrow via the platform's payment gateway. Funds remain in escrow until the work is approved or automatically released.

The escrow state is the single source of truth for the status of a contract. Funds never move without a corresponding state transition, and every transition creates an immutable audit record.

6.4 Delivery and Approval

When a freelancer submits a deliverable, the client has 7 days to approve the work, request a revision, or raise a dispute. If the client takes no action within 7 days, the system automatically releases the escrowed funds to the freelancer.

If the client requests a revision, the freelancer may rework and resubmit. Each new submission resets the 7-day auto-release timer.

7. Dispute Resolution

Either party may raise a dispute on an active contract. When a dispute is raised, all escrowed funds are immediately frozen until the dispute is resolved. Mawaheb uses a three-tier dispute resolution process:

Tier 1 — Direct Resolution (72 hours)

Both parties are given 72 hours to resolve the dispute directly through the platform's messaging system. If the parties reach an agreement and both confirm the resolution, the platform administration reviews and releases funds accordingly.

Tier 2 — Evidence Submission (72 hours)

If the dispute is not resolved during Tier 1, it is automatically escalated. Both parties are notified and given 72 hours to submit supporting evidence, including screenshots, files, chat exports, and work samples.

Tier 3 — Administrative Decision (up to 7 days)

The Mawaheb administration reviews all evidence submitted by both parties and renders a final decision within 7 days. The decision may result in:

  • Full release of funds to the freelancer.
  • Full refund to the client.
  • A partial split of funds between both parties at a percentage determined by the administration.

The administrative decision at Tier 3 is final and binding. Both parties agree to accept the outcome of the dispute resolution process as a condition of using the platform.

Users who are involved in 3 or more disputes within a 90-day period may be flagged for review and subject to account restrictions or suspension.

8. Payouts

When funds are released to a freelancer's wallet, the freelancer may request a payout through one of the following methods:

  • Jawwal Pay: Funds are transferred to the freelancer's Jawwal Pay account.
  • Bank Transfer: Funds are transferred to the freelancer's Palestinian bank account via IBAN.
  • Cash Pickup: The freelancer collects funds through a local agent coordinated by the Mawaheb administration.

Mawaheb aims to process all payout requests within 48 hours. Payouts are processed manually by the platform administration. Once a payout is marked as sent, the freelancer is notified and asked to confirm receipt. If the freelancer does not confirm within 24 hours, the payout is automatically marked as confirmed.

Freelancers are solely responsible for providing accurate payout details. Mawaheb is not liable for funds sent to incorrect accounts due to inaccurate information provided by the freelancer.

Payout method details (bank IBANs, Jawwal Pay numbers) are stored using AES-256 encryption and are only decrypted during payout processing by authorized administrators.

9. Reviews and Ratings

After a contract is completed, both the client and freelancer are prompted to leave a review. Mawaheb uses a blind review system: neither party can see the other's review until both have submitted their ratings.

Reviews include star ratings (1–5) across multiple dimensions and an optional written review of up to 500 characters. Once both reviews are submitted, they become visible on both users' public profiles. If only one party submits a review, that review will become visible after 14 days regardless.

Reviews must be honest, relevant to the contract, and free of personal attacks or discriminatory language. Mawaheb reserves the right to remove reviews that violate these guidelines.

10. Intellectual Property

Upon full release of payment from escrow to the freelancer, all intellectual property rights in the work product created under the contract transfer to the client, unless explicitly agreed otherwise in the contract terms.

The freelancer retains the right to display the work in their Mawaheb portfolio for self-promotion purposes, unless the client explicitly requests otherwise.

All content, branding, design, code, and materials that constitute the Mawaheb platform are the exclusive property of Mawaheb. You may not reproduce, distribute, or create derivative works from our platform content without our prior written consent.

11. Account Suspension and Termination

Mawaheb reserves the right to suspend or terminate your account if you:

  • Violate any provision of these Terms of Service.
  • Engage in fraudulent, deceptive, or illegal activity.
  • Are involved in repeated disputes that indicate a pattern of bad faith behavior.
  • Attempt to circumvent the platform's payment or escrow systems.
  • Harass or threaten other users or Mawaheb staff.

Upon account deletion (whether by your request or by administrative action), your personal information will be anonymized. However, financial records, contract data, and payment audit trails are retained permanently in accordance with legal and regulatory requirements.

Any funds remaining in your freelancer wallet at the time of account termination will be processed as a final payout, provided there are no active disputes.

12. Limitation of Liability

Mawaheb provides the platform on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the platform.

To the maximum extent permitted by law, Mawaheb shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to:

  • Loss of profits, revenue, data, or business opportunities.
  • The quality, timeliness, or legality of work performed by freelancers.
  • The ability or willingness of clients to pay for contracted work.
  • Disputes between users.
  • Unauthorized access to your account due to your failure to protect your credentials.

In no event shall Mawaheb's total aggregate liability exceed the total commissions paid by you to Mawaheb in the 12 months preceding the event giving rise to the claim.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Palestine. Any disputes arising from or relating to these Terms or your use of the platform that are not resolved through our internal dispute resolution process shall be submitted to the competent courts in Palestine.
